Dukes Films Terms & Conditions

By accessing or using the Dukes Films website, services, booking systems, or communications, you agree to be bound by these Terms & Conditions and our Privacy Policy.

2. Services

Dukes Films provides video production, video marketing strategy, content creation, and paid advertising management services.

Specific project scope, pricing, timelines, and deliverables are defined in individual proposals, invoices, or service agreements. Those documents take precedence if any terms differ from this page.

3. Consultations and Communications

By submitting a contact form, scheduling a call, or communicating with Dukes Films, you consent to receive responses via email, phone, or text message regarding your inquiry or services.

If SMS communication is used:

  • You may opt out at any time by replying STOP

  • Reply HELP for assistance

  • Message and data rates may apply

Dukes Films will not share or sell your contact information to third parties for marketing purposes.

4. Payments and Refunds

Payment terms are outlined in each service agreement or invoice.

Unless otherwise stated:

  • Deposits are non-refundable once work has begun

  • Final deliverables may be withheld until payment is completed

  • Advertising spend paid to platforms such as Meta or Google is non-refundable

5. Intellectual Property

All creative materials, including but not limited to scripts, concepts, raw footage, edited videos, graphics, and advertising assets, remain the property of Dukes Films until full payment has been received.

Upon full payment, usage rights or ownership transfer according to the terms outlined in the client’s agreement. Dukes Films retains the right to display completed work for portfolio, website, social media, and marketing purposes unless otherwise agreed in writing.

6. Marketing and Advertising Disclaimer

While Dukes Films uses proven strategies to improve marketing performance and generate leads, results are not guaranteed. Advertising performance may vary based on market conditions, competition, offer quality, budget, and external factors beyond our control.

Clients are responsible for:

  • Accuracy of business claims

  • Compliance with advertising laws and platform policies

  • Handling and closing leads generated from campaigns

7. SMS Messaging Terms

SMS Program Description

By providing your mobile phone number through our website, lead forms, or other communication channels, you consent to receive SMS text messages from Dukes Films related to your inquiry, services, appointments, updates, or other business communications. Message frequency may vary depending on your interaction with our services.

Consent to Receive Messages

By submitting your phone number, you confirm that you are the authorized user of the number provided and that you consent to receive text messages from Dukes Films. Consent to receive SMS messages is not a condition of purchasing any goods or services.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and service plan. Dukes Films is not responsible for any charges incurred from your mobile carrier as a result of SMS communications.

Opt-Out Instructions

You may opt out of receiving SMS messages from us at any time by replying STOP to any message you receive. After you send the STOP message, you will receive one confirmation message and will no longer receive SMS communications from us unless you opt in again.

If you need assistance with SMS communications, you may reply HELP to any message or contact us directly through our website or support channels.

Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. SMS delivery is subject to effective transmission by your mobile carrier and may be affected by factors outside of Dukes Films’ control.
